This Year’s Heisman Heist

The Heisman trophy was awarded last Saturday to Auburn’s Cam Newton, in a very well prepared, tasteful and entertaining presentation on national TV, graced with the presence of numerous past successful Heisman trophy candidates, and Auburn’s Bo Jackson not only being among them for the first time since he received the award 25 years ago but providing probably the funniest moment of the show when responding to an inquiry about why he had finally attended this year after staying away so long – after saying all of the right things like that it was “special” this year because not only was it the “Silver Anniversary” of him receiving the award, but one of the four finalists, Cam Newton, was a fellow Auburn player, he rolled his eyes and “cut to the chase,” saying, besides, “my wife said I had to go.” But in this writer’s opinion, there is some “tarnish” on that once prestigious trophy each year, resulting from (i) the premature determination of which player is entitled to this award, (ii) the all too frequent occurrence of the holder of the Heisman trophy being out-played by one of the other finalists in a BCS bowl game (often the BCS Title Game), and (iii) the fact that some past “Heisman’s” (like Gino Toretta of Miami) have gone on to become total flops in the NFL. But despite all the hype this year, with the BCS bowl schedule having been announced the previous Sunday and pitting the teams of two of the four finalists (Auburn’s Cam Newton and Oregon’s Le Michael James) against each other in the BCS Title Game, the build up to the awarding of this prestigious trophy for the best collegiate player in the country was somewhat over-shadowed by the controversy surrounding the recruitment of Cam Newton and the alleged “play for pay” demands that his father, preacher Cecil Newton, had made to at least one person trying to recruit Cam to Miss state during the previous off-season.

But first things first – let’s get to our major “beef’ about the Heisman Trophy, which is not so much how the voting is done and who gets to vote, as it is about the timing of the award. It’s easy to see why Auburn’s Cam Newton and Oregon’s Le Michael James were two of the four finalists for the Heisman Trophy award, in addition to Stanford’s Andrew Luck and Boise State’s Kellen Moore, based on what they and their teams have accomplished on the field this season. And both Newton and James will be playing in the BCS championship game on January 10 between Auburn and Oregon (in which Auburn is favored by 3 points), with their teams ranked #1 and 2 in the final BCS rankings. But what a golden opportunity that game would have been to determine not only which team is the best college FB team TY (although there will surely be some protests by TCU supporters if the Horned Frogs beat Wisconsin in the Rose Bowl), but which one of those two players actually deserves the award more (which would surely make that game into even more of a TV ratings blockbuster and advertising “cash cow” than it already is). And our recommendation of delaying the final Heisman Trophy voting until AFTER THE FINAL BOWL GAME is also supported by the so-called “Heisman jinx” -- the fact that the Heisman holder’s team has often struggled to finish the season off with a National Championship (of the 28 previous quarterbacks to have been awarded the Heisman, just seven/25% were victorious in the national championship that same year). And it has happened three times in the last five years that the top two vote getters in the Heisman race also squared off in the BCS title game – LY with Texas and Heisman runner-up Colt McCoy playing Alabama and their Heisman recipient Mark Ingram, in 2008 with Heisman award recipient Sam Bradford of Oklahoma playing against Florida and runner-up Tim Tebow, and in 2005 with Heisman award recipient Reggie Bush of USC squaring off against runner-up Vince Young of Texas. And guess what? The runner up’s team prevailed in two of those three games, and Alabama’s victory over Texas LY has an asterisk by it, with Texas QB Colt Mc Coy having suffered a game ending (for him) injury early in the 2Q, which effectively killed the Longhorns’ chances. And if the Heisman voting had taken place AFTER either the Florida-Oklahoma game or the Texas-USC game, as we suggest, the chances of Reggie Bush beating out the inVINCEable Vince Young in 2005 and of Sam Bradford beating out Tim Tebow in 2008 for that award would have been about the same as for Rose Ann Barr or Rosie O’Donnell becoming the next Miss America. But unfortunately, our idea makes too much sense, so it did not come to pass TY, and it may never will, as long as we have a collective group of numbskulls calling the shots for how and when the Heisman Trophy is awarded.

And now we come to our "other issue” with the Heisman trophy, that being the awarding of this year’s trophy to Cam Newton. And while I would have preferred Andrew Luck to get the award, after guiding “my” team (and alma mater) Stanford to an 11-1 record (it’s best in 70 years since the undefeated/10-0 “Wow Boys,” who became the national champions in 1940 with a Rose Bowl victory over Nebraska), a #4 BCS ranking and a berth in the prestigious Orange Bowl, there is no question that Newton’s on the field accomplishments qualified him as a Heisman finalist, although it’s anybody’s guess as to whether he deserved it more than the other 3 finalists. But the unique thing about Cam Newton was all of the controversy which arose late in the season regarding his recruitment (not by Auburn but by Miss State), throwing a potential “monkey wrench” into Auburn’s “dream season” during the week just before Auburn’s traditional rivalry game against Georgia, with its potential adverse impact not only on Newton’s chances of getting the Heisman, but also his eligibility to continue playing for Auburn, which was in the stretch run of its quest for ’s one of the coveted two spots in the BCS Title Game and had two major obstacles (their upcoming home game against Georgia and their road game at Alabama the following week) in their path.

In any event, here’s my take on the whole "Cam and Cecil Newton thing." I won’t include a detailed explanation of the facts creating the controversy, as probably at least 90% of our readers are well aware of them. The one thing that’s not in dispute is that Cam Newton’s father Cecil, who told Cam that he would “handle” dealing with the myriad of college “suitors” who would be calling after Cam’s great season in junior college the year before, did a “shake down” job on Miss State, which is not only a violation of NCAA rules but is arguably a federal (RICO) crime as well, for which I hope he is prosecuted, because the only way the NCAA could “punish” him is to compromise his son’s eligibility, which would be both regrettable and unfair (IMO) to Cam Newton, assuming he was totally unaware of his father’s actions, as both he and father/preacher Cecil insist is the case.

And if the CFB “recruiter” entertained and passed along Cecil’s request for money to MSU coaches, rather than telling “old man Newton” that paying for college athletes is illegal and he should “go elsewhere” (like maybe to hell) if that’s what his deal is, then the recruiter can and should be banned for a significant period from having any communications with colleges, recruits or anyone acting on behalf of any recruits. And assuming that Newton’s request for money was not “entertained” by MSU, then MSU should not be sanctioned, but if it was not summarily and clearly rejected, I’m not so sure that MSU should escape totally “unscathed” just because Cam Newton did not end up there.

But obviously the main focus is and should be on Cam Newton and Auburn, not on Miss State and the recruiters who worked on MSU’s behalf. And as much as I don’t want to see Cam being punished for the “sins” of his controlling and “ethically challenged” father Cecil, it seems that the NCAA allowed itself to be manipulated by Auburn declaring Newton temporarily “ineligible” for the huge Alabama game TG weekend, pending a ruling by the NCAA on his eligibility, obviously pushing for immediate resolution and closure of the matter by the NCAA. And if the NCAA had not become a willing victim of that manipulation, there is no way in hell that Cam would not have “magically” had his eligibility restored by Auburn just in time for that Alabama game. But with their handling of the Cam Newton situation and their ultimate ruling, in favor of Cam Newton and Auburn, I believe the NCAA has set a potentially dangerous precedent by creating a major loophole for recruiting violations, as it permits unscrupulous and controlling parents (like Cecil Newton) to do the kind of bad things that Cecil did, while allowing their sons to escape the consequences of those actions, as long as the son claims he did not know about his parent(s)’ wrongdoing, and it cannot be proven that he did know, as seems to be the case with Cam Newton. And now USC’s new AD, former USC star QB Pat Haden, who (like myself) also happens to be an attorney, is asking the NCAA how the Newton situation is any different from the USC/Reggie Bush recruiting scandal, where USC got reamed by the NCAA and Bush was stripped of his Heisman trophy, despite claiming that he was not aware of whatever deals were made between USC boosters and his parents (although one has to wonder how Reggie could not possibly think that something was “amiss” when his parents were suddenly able to move from “the hood” in San Diego into a $750K house in suburban San Diego and “afford” to live there while he attended and played for USC). While the NCAA has released some statements in an attempt to distinguish the two similar situations with strikingly different results, the main distinction seems to be that while no evidence has been uncovered (at least not yet) that Cecil Newton or his church benefitted from any money from Auburn or anyone associated with that university, Bush’s parents clearly benefitted from the “perks” bestowed upon the Bush family by grateful USC “boosters,” such as the one who owned that $750K house where the “Bush clan” was able to live rent-free while son Reggie attended and played for USC.

And that gets us back to the main questions of (i) what benefit(s), if any, did Cecil Newton and/or his church actually receive from Auburn for “delivering” Cam to “the plains” of Auburn, Alabama and (ii) if any such benefits can be substantiated, what sanctions, if any, should be levied against Auburn, the answer to which would clearly have some major impact on Cam Newton going forward, even though he apparently will retain his eligibility, at least for the BCS Title Game (unless some major “skeleton” suddenly falls out of Cecil Newton’s closet), and even though the “tarnish” on Cam from this scandal did not have enough of an adverse effect to prevent him from being awarded the Heisman Trophy, nor did it prevent undefeated Auburn from getting a spot in the BCS Title Game. And while I know Auburn completely denies any wrongdoing in Cam Newton’s recruitment, and there is no admission or evidence of any similar “shake down” by Cecil Newton directed at Auburn, the facts still point to some anonymous Auburn booster(s) funneling the money to pay for the more than $50K of urgently needed repairs to Cecil Newton’s church (of which he was/is the pastor), which was in danger of being shut down by the city (in Georgia) where it is located, for multiple code violations. Note the following “pieces to the Cam and Cecil Newton puzzle:”

1. Cecil Newton’s church was in danger of imminently being shut down by the city for multiple code violations, and the estimated cost of fixing those violations was about $50K.

2. All of those violations “magically” were fixed after Cam Newton committed to Auburn, but no one is saying where the money came from, and no one has produced any check(s) from “God” or any other evidence of “divine intervention” as the source of payment. And I assume that Cecil Newton would is claim, if pressed, that the money came in the form of cash from one or more “anonymous donor(s).”

3. Some people are saying that the Newton family was not hurting for money, but if either Cecil or another family member (other than Cam) paid for the repairs, then it would be a simple matter for Cecil to simply state that, and offer to provide one or more cancelled check(s) as support (but that has not happened, and I seriously doubt that it will, because that presumably is not how the repairs were bank-rolled).

Although it seems like a “connect the dots” thing to find Auburn guilty of an NCAA violation based on items 1, 2 and 3 above, as an attorney I realize that’s all circumstantial evidence, and by itself is not enough to “convict” Auburn. But it seems that it should be easy enough for the NCAA to identify and contact the contractor(s) who did the work at the church, and ask them where the money came from, and if they won’t disclose that, have the FBI “interview” them as well (the FBI also interviewed at least one of the recruiters trying to get Cam Newton to attend Miss State, presumably at the request of the NCAA). And if the money was ‘wired’ or paid by a cashier’s check, it would be easy enough to determine where and from whom it came. On the other hand, I seriously doubt that some Auburn “supporter(s)” just showed up one Sunday at Cecil Newton’s church and put $50 K cash in an envelope in the collection plate. But if that is how the repairs were actually funded, that would be very tough, if not impossible, to prove.

Again, it seems that the NCAA is potentially creating a major loophole for recruiting violations by setting a precedent in the Newton case that a college athlete cannot be punished for the “sins” of his father, but based on the facts as I understand them, I’d hate to see such a talented and successful college athlete as Cam Newton be taken down along with his father. So the question becomes how can these seemingly “innocent” college athletes and recruits like Cam Newton be protected against controlling, unscrupulous parents like Cecil Newton w/o creating a major loophole for recruiting violations (i.e., allowing the parent to do the “shake down,” and then if things blow up like they did here, have the “kid” and the school where he ended up get off “scot free,” by claiming, as Cam Newton and auburn have, that he/they knew nothing about it?) The answer, IMO, lies with the “feds,” who I believe have grounds to prosecute Cecil Newton for RICO crimes based on (i) incriminating statements by recruiters trying to “match” Cam Newton with MSU, (ii) one or more taped phone conversations with Cecil Newton discussing the “play for pay cash requirements” for Cecil “delivering” his son to MSU, and (iii) the fact that those phone calls were interstate calls. And if Cecil Newton were to be interviewed by the FBI, and it could be proven that he lied to the FBI under oath, then Cecil could also be prosecuted for perjury. If Cecil goes down, as he should, that would seem to be an adequate deterrent to this kind of thing recurring in the future.

Maybe I’m a bit prejudiced against “men of the cloth” like Cecil Newton and some of these “holier than thou” high profile evangelists who turn out to be big-time hypocrites in reality, but I really hope Cecil Newton is forced to face serious legal consequences for what he appears to have done, without taking his son Cam down with him.
